kundërshtimin e vendimit të Komisionit të Vlerësimit të Ofertave mbi skualifikimin e ofertës të
paraqitur nga BOE “Filo Gas” SHPK & “LG West Balkan si dhe kualifikimin e operatorit ekonomik
“Messer Albagas” SHPK, pjesëmarrës në kete procedure prokurimi.Kjo ankese eshte publikuar ne regjistrin e ankesave date 16.03.2022. Eshte skualifikuar operatori ekonomik i meposhtem: - BOE FILO GAS&LG WEST BALKAN per arsye: 1. Operatori ekonomik Filo Gas ne formularin e vetdeklarimit ka deklaruar se ka paguar te gjitha taksat tatimet dhe sigurimet shoqerore e vertetuar kjo me vertetimin e 14.02.2022, ku realisht vertetimi i date 14.02.2022 i ngarkuar ne spe tregon qe operatori ka detyrime prej 47593 leke. 2. Operatori ekonomik LG West nuk ka paraqitur vertetimin e xhiros vjetore per vitin 2018 2019 2020. 3. Ne lidhje me deshmite per kontratat e ngjashme operatori ekonomik Filo Gas ka paraqitur faturat tatimore per oksigjen ku vlera totale e tyre nuk permbushen 25% e 40% te kontratave te ngjashme. Gjithashtu keto fatura nuk jane te vulosura dhe te firmosura dhe nuk jane te deklaruara ne organet tatimore sipas pikes b te 2.3.1 te kapacitetit teknik. Operatori ekonomik ka paraqitur vertetim realizimi ku vlera e kontrates eshte shprehur ne modhen denare dhe jo ne monedhen tone, si dhenje vertetim eshte vlera me tvsh ku komisioni e ka te pamundur ta zhveshe nga tvsh fondin limit ten je shteti tjeter. 4. Autorizimi per tregtimin e mallrave leshuar operatorit ekonomik LG Wesr Balklan jane ne gjuhen angleze . 5. Certifikate ISO 9001 e LG West eshte ne anglisht. 6. Certifikate ISO 450001 e LG West mungon. 7. Kontratat e tankerave jane pa noter. 8. Operatori ekonomik Filo Gas nuk permbush kriterin 2.3.8 per kapacitetin e tankerave 5000-10000 litra. 9. Ne lidhje ma piken 2.3.7 Operatoim ekonomik per tankerin me depozite 50000 litra fatura e paraqitur nuk eshtte origjinale dhe kontrata e shitblerjes e panoterizuar. |
