Po ka patur ankesa. Me shkresën nr.14083 prot datë 14.08.2019 protokolluar pranë Autoritetit Kontraktor Bashkia Shkodër ka paraqitur formularin e ankesës për prokurimin në lidhje me vendimin e KVO , operatori ekonomik ”Nika“ sh.p.k . Me shkresen nr.14083/1 prot datë 19.08.2019 iu kthye pergjigje operatorit ekonomik ”Nika” sh.p.k duke mos marre ne konsiderate pretendimet e tij dhe duke e refuzuar ate. Ka ofertues te skualifikuar. 1-U skualifikua operatori ekonomik “ Delia Impex”sh.p.k, per keto arsye: -Nuk ka paraqitur asnje document 2-U skualifikua operatori ekonomik“Nika” sh.p.k. per keto arsye: 1-Nuk ka paraqitur listepagesat e muajit te fundit ,maj 2019 sipas kerkesave te DST,kapaciteti teknik pika 4. 2-Ne vertetimin per Kontributet e Sigurimeve Shoqerore e Shendetesore per Tatimpaguesin - E-SIG 02/a mungon muaji I fundit ,maj 2019 sipas kerkesave te DST,kapaciteti teknik pika 4. 3-Autobitumatricja me targa AA230 HV nuk ka çertifikatë për transport mallrash të rrezikshëm lëshuar nga institucionet perkatese (e vlefshme) si dhe i ka mbaruar afati i vlefshmerise se polices se sigurimit. 4-Mungon kontrata e qerase per autobitumatricen me targa AA230 UL si dhe fotoja per identifikimin e mjetit. 5-Nuk ka paraqitur dokumentacion se dispononi minifadrome sipas kerkesave te percaktuara ne DST,pika 11, kapaciteti teknik. 6-Nuk ka paraqitur certifikaten PAS 99-2012 mbi « Sistemi i menaxhimit te integruar » 3-U skualifikua operatori ekonomik “ Company Riviera 2008”sh.p.k. per keto arsye: Oferta juaj skualifikohet ne baze te kerkeses tuaj per terheqje nga procedura 4-U skualifikua bashkimi i operatoreve ekonomik “MF Invest Group”sh.p.k & “Mane/S”sh.p.k -Kontrata e bashkepunimit midis dy shoqerive pjesemarrese nuk eshte bere sipas VKM nr.914, dt.29.12.2014“Për Miratimin e Rregullave te Prokurimit Publik“e ndryshuar ,neni 74,pika 2, ku thuhet „Para dorëzimit të ofertës, bashkimi duhet të krijohet zyrtarisht, me një marrëveshje të noterizuar, ku të përcaktohen përfaqësuesi i grupit, përqindja e pjesëmarrjes së punës/shërbimit/furnizimit dhe elementet konkrete, që do të kryejë secili nga anëtarët e këtij bashkimi” pasi ne kontraten e bashkepunimit nuk ka percaktuar elementet konkrete qe do te kryeje secili nga anetaret e ketij bashkimi. -Nuk ka paraqitur deklaratat per mosangazhimin e fuqise punetore sipas pikes 4,kaoaciteti teknik ne dst -Mungon vertetimi leshuar nga OSHEE per shoqerine “MF Invest Group”sh.p.k 5-U skualifikua operatori ekonomik “ “PE-VLA-KU”sh.p.k., per keto arsye: -Mungon diploma e shkolles se larte per teknikun e ndertimit -Mungon dokumentacioni shoqerues per autobitumatrice -Nuk ka paraqitur vetdeklarimin sipas pikes 3 te DST,kapaciteti teknik -Mungon kontrata e punes se manovratorit -Makinerite e marra me qera sipas lejes se qarkullimit dhe certificates se transportit jane per perdorim vetjak dhe jo per te trete. |
