Eshte skualifikuar operatori ekonomik i meposhtem: - Ina shpk per arsye Komisioni i Vleresimit te Ofertave, mbas verifikimit te ofertave te paraqitura, beri llogaritjet per te pare nese ka oferta anomalisht te uleta duke aplikuar formulen e percaktuar ne rregullat e prokurimit publik neni 82 pika 4 “ Në rastin kur janë të vlefshme dy ose më pak oferta, në përputhje me nenin 93, të LPP-së, oferta vlerësohet anomalisht e ulët kur ajo është ulur më shumë se 25% e fondit limit të përllogaritur;” Mbas llogaritjeve te bera u konstatua se oferta e paraqitur nga shoqëria “Ina” sh.p.k ishte me cmim anomalisht te ulet,ne keto kushte bazuar ne 93 pika 1 dhe 2 e Ligjit Nr. 162 dt. 23.12.2020 “Për Prokurimin Publik” , me shkresën Nr 5517 date 17.06.2022 KVO ka kërkuar shpjegime per justifikimin e cmimeve te propozuara ne oferte . Shoqëria “Ina” sh.p.k nuk ka dorëzuar asnjë sqarim apo argumentim lidhur me ofertën e paraqitur prej saj. Duke qënë se ofertuesi nuk ka dorëzuar sqarime lidhur me ofertën e paraqitur prej tij, bazuar në nenin 93 të LPP dhe VKM 285 datë 19.05.2021 “Për miratimin e rregullave të prokurimit publik” nenin 82 pika 4 ku përcaktohet shprehimisht se : “Në çdo rast, ofertuesi ka detyrimin të argumentojë dhe të dokumentojë me prova shkresore, sqarimet për elementin/elementet e veçanta të ofertës, në përputhje me kërkesat e nenit 93, të LPP-së. “, oferta e paraqitur prej tij refuzohet. |
